For the purposes of this document RVDK Labourhome Private limited shall be termed as “Labourhome” and Arth Buildcon shall be termed as "Customer".
Scope of Customer
- Customer shall provide proper accommodation to our workers which shall include lights, fans, electricity, proper toilets, and wash area.
- Customer shall provide transportation from the accommodation to the work site and back to the accommodation if the accommodation facility is more than 2 km from the work site.
- Customer shall provide all PPE free of cost to the workers.
- Customer shall provide the tools and consumables to the workers free of cost.
- Customer shall provide all materials free of cost including Formwork, staging, etc. to the workers for the works. The responsibility of the materials shall be with the customer and not with Labourhome.
Tech Adoption
a) Labourhome is a Tech Enabled Labour as a service Platform. We are live with our application on Playstore. We would be requesting the customer to download our Application from the Playstore and perform the following for us to service your workforce request:
- Install Labourhome Application from Playstore
- Choose your Language Preference
- Choose the Customer workflow in the application
- Fill the needed fields and submit your login request for our sales team to get in touch with you to close the Sales process.
b) Labourhome Sales team and Finance team shall undertake a detailed due diligence exercise of the customer and study all key metrics before going ahead with acceptance of any order.
c) The customer shall consider the order acceptance from Labourhome on generation of Service Agreement from the Labourhome Stack with terms and conditions as mentioned part of this submitted offers. Any work order or Purchase orders issued by customers to Labourhome shall be superseded by the contents of system-generated service agreement jointly signed by Labourhome and customer.
d) The customer shall be trained on the Tech and platform journey after the service agreement is signed by both Labourhome and customer. The Customer Journey in the Tech stack requires the following:
- Customer shall provide the worker bookings through the Application
- Customer can track his bookings through the Application
- Customer can check the Nano contractors and workers assigned for the bookings through the Application
- Customer shall check the DLR and approve/reject the same on Daily / weekly basis through the application. Any DLR entry not cleared for more than 2 working days shall be auto approved and deemed as accepted by the customer.
- Customer shall check and approve the Invoice through the application
- Customer will be able to check the productivity reports through our application
Pricing and Billing
a) The quoted rates for the wages and the LH margins quoted over and above the wages of the workers are exclusive of GST @ 18%. Any changes to the GST rates shall be reimbursed at actuals.
b) The bills shall be generated once a month on every 2nd day of the calendar month. The Bills shall be the cumulative monthly wage of workers deployed for the previous month from the 1st working day of the month to the 30th/31st working day of the month plus LH Margin quoted as a percentage of cumulative monthly wage.
c) The Invoice must be approved before the 5th day of the calendar month on the Application panel and processed for payments.
d) The payments must be paid to the account of Labourhome on or before the 15th of the calendar month. Any delay in payments beyond this date shall attract a delay interest of 18% on the outstanding provisions of MSME Act. Any works done by the workers as additional overtime hours shall be charged to the customer in the invoice. The LH Margin shall be charged at the rates mentioned in column D over and above the cumulative monthly overtime wages.
Statutory Compliances
Labourhome is a Tech Enabled platform helping nano contractors and its workers avail job opportunities from the Construction Industry. The quoted price is exclusive of any involvement and accountability of Labourhome on the Statutory compliances of the workers. All the responsibility of statutory compliance shall be with the customer and they shall indemnify Labourhome against any act of violation from the guidelines set by the government authority. The Customer if intends to get the statutory compliances complied and met from Labourhome as an additional service the same must be communicated in writing to Labourhome in the Service Agreement. The Cost towards the compliance shall be reimbursed at actuals by the customer plus LH margins shall be paid over and above the cost of compliance.
Period of Mobilisation
Labourhome generally takes 15 to 21 days to complete any bookings. As the Mobilisation process involves cost, within the agreed Turnaround time the customer once places a booking shall not reject the crew once they have reached the site on account of fulfilment of the same booking by some other agency.
Retention Money
Labourhome is a tech-enabled platform and is not a Job work contractor, so we do not hold retention money of our nano contractors and similarly, we do not agree for any retention money hold from our customer.
Termination of Booking
The Customer shall close the booking from their My Bookings panel in the Application. The Notice period of closure of any booking and demobilisation from the site shall be 15 days. The workers must be given work wages and overtime during the Notice period as well.
Final Invoice
The Customer shall approve the Final invoice from the approvals section of the application and make the payments within 15 days from the date of invoice.
